It is not possible for you to just throw out your tenant and his belongings because he has not paid rent for two months or just because he has violated the lease norms. First you must ask him orally and find out what he tells on explanation. Give him maximum of one week and tell him clearly you will be serving eviction notice if he did not pay the rent in full within that time. The state laws of many countries are more or less the same in the time limit given to the tenant for vacating the house.

See that the notice is properly served on the tenant; otherwise he may tell the court that he has not received any eviction letter at all. Ensure the notice is hand-served on him and keep the acknowledgement with you. Give him 3 or 5 days time to repay the rent. If he ignores your eviction notice, then you have no other option but to file a lawsuit in the court. Find out what the local court in your state says about evicting the tenant and accordingly move a petition of unlawful detainer in the court. In other words, you have to file a legal complaint in the court requesting them to issue summon to the tenant.

Remember you have to submit the proof of serving the notice to the tenant in the court. And establish your stand carefully saying no corrective action is taken by the tenant so far. The court normally hears your case and allows one week’s time for the tenant asking him to appear before the court. In the mean time, if the tenant pays the rent in full or corrects his action then you need not proceed further with the case. You can just tear off the eviction notice given. In case if the tenant admits his incapacity to pay the rent before the court, then the court may, further give him one more week for vacating the premises. After the lapse of time, the court will send him the eviction order which is usually pasted on the door of the tenant. You can approach the local sheriff if the tenant still creates problem in vacating the house, even after accepting orders from the court.
